TembeaGo is currently available for bookings in Kenya only. The following terms of service apply to all users looking for bookings in Kenya.

Terms for Our Guests
1. Searching and Booking on TembeaGo
1.1 Searching
You can explore a wide range of listings on TembeaGo by applying search criteria such as destination, travel dates, number of guests, type of accommodation or service, and available amenities. Our platform also provides filters to help you refine your search results for a more personalised experience.
Search results are determined based on their relevance to your chosen criteria and other factors, which may include price, availability, guest reviews, customer service history, popularity, Host response rate, cancellation record, and compliance with listing requirements. These results are designed to help you make informed choices.
1.2 Booking
When you make a booking on TembeaGo, you agree to pay all applicable charges associated with your reservation. This includes the listed price, service fees, taxes, and any other amounts identified during checkout (collectively referred to as the "Total Price").
Upon receipt of your booking confirmation, a legally binding agreement (a "Reservation") is formed directly between you and the Host. By completing the booking, you acknowledge and accept that:
- The contract includes these Terms, the terms of the specific reservation, and any applicable rules, standards, policies, and house requirements included in the listing or disclosed during checkout.
- It is your responsibility to carefully review all of these terms before confirming your booking.
- Some Hosts may work with co-hosts or representatives to manage their accommodations or services, and your contract will extend to those recognised co-hosts as necessary to fulfil your reservation.
1.3 Accommodation Reservations
An accommodation reservation made through TembeaGo grants you a limited licence to occupy and use the accommodation for the agreed period. The Host retains the right to re-enter the accommodation when it is reasonably necessary, permitted by your contract, and in accordance with applicable Kenyan law. If you remain beyond your agreed checkout time, the Host has the right to request that you vacate the premises and may charge reasonable overstay fees.
1.4 Reservations for Experiences, Services, and Other Host Offerings
A reservation for an experience, guided service, or other Host-provided activity entitles you to participate in or use the service as described in the listing. You are responsible for ensuring that you and anyone accompanying you meet all age, proficiency, fitness, safety, and eligibility requirements stated by the Host.
2. Cancellations, Reservation Issues, Refunds and Booking Changes
2.1 Cancellations, Reservation Issues, and Refunds
If you choose to cancel a reservation on TembeaGo, the amount refunded will generally depend on the Host's cancellation policy for that specific listing. Each Host sets their own cancellation terms (such as flexible, moderate, or strict), which are clearly displayed before you confirm your booking.
If the Host cancels your reservation or if you experience a Reservation Issue, you may be entitled to rebooking assistance or a partial or full refund in line with TembeaGo's Rebooking and Refund Policy.
2.2 Booking Changes and Modifications
Guests and Hosts can request to modify an existing reservation through the TembeaGo platform or by contacting Customer Support. Any changes must be mutually agreed upon by both parties before they take effect.
2.3 Host Initiated Cancellations
If a Host cancels a confirmed reservation, TembeaGo will notify you promptly and provide assistance with finding a comparable alternative or issue a refund where applicable.
2.4 Exceptional Circumstances
In rare cases where national regulations, safety concerns, or legal obligations prevent the completion of a reservation, both Guests and Hosts agree that TembeaGo may cancel the reservation on their behalf in the best interest of all parties. Refund eligibility in such cases will follow TembeaGo's Disruption and Force Majeure Policy.
3. Guest Responsibility and Assumption of Risk
3.1 Your Responsibilities
As a Guest on TembeaGo, you are responsible for your own actions and omissions as well as the actions and omissions of any person you invite, bring with you, or allow access to any accommodation, shared facility, or Host provided service. Specifically:
- You must leave the accommodation in the same condition as upon your arrival, reasonable wear and tear excepted.
- You are responsible for any damage to property or excessive cleaning required due to your acts or omissions.
- You must act honestly, respectfully, and in compliance with all applicable laws, property rules, and community regulations.
- If you book on behalf of other guests, you must ensure each guest meets the Host's requirements and agrees to these Terms.
- If you are booking or bringing a minor, you must be legally authorised to act on their behalf and are solely responsible for their supervision and wellbeing.
3.2 Your Assumption of Risk
By using TembeaGo and participating in any Host Service, you acknowledge that certain experiences naturally involve inherent risks, which may include risks of property loss, illness, personal injury, disability, or death. You freely and voluntarily assume all such risks to the fullest extent permitted by law. TembeaGo is not liable for injuries, losses, or damages that occur as a result of inherent or reasonably foreseeable risks, except where caused by negligence or misconduct on the part of TembeaGo.
